THE CASE OF Peter Fagan of Feltrim.

RIchard Fagan (Brother to the said Peter, and under whom he claims) is Prov'd by the Queen's Warrant for Reversal of his Out-lawry (grounded upon the Cases ha­ving been Examin'd by Sir George Treby then Attorney General) to have quitted his Command of an Old Company, pursuant to their Majesties Declaration of the 22d. of February 1688, and to have retir'd to his Habitation, and to have liv'd Inoffensively (without re-taking any Imployment, either Civil or Military) till he was Murther'd Aug. 1690, by Rapparees in the English Quarters, for Owning Their Majesties.

All these particulars are also farther Prov'd by Affadavits Viva Voce, lately taken before Judges and Masters of Chancery in London, which Affadavits, together with the above men­tion'd Warrant, are annex'd to the Report made by the Trustees here.

His being However contrary to Law, Justice and Reason Out-law'd after Death, is Prov'd by the Certificate of the Proper Officer of Ireland (who is now in Town) and the same is Acknowledg'd by the Trustees, and the Certificate annex'd to their Report.

And this Groundless and Illegal Out-lawry standing Ʋnrevers'd, the said Peter Fagan can have no Relief, but by Humbly applying (as he now doth) to the Ju­stice and Compassion of the Honorable the House of Commons, for the Reversal thereof.
