¶ To hold in fre hold is to hold for terme of his own lyfe or for terme of another­mannys lyfe and in this case the fee and the ryght remayneth in the person of hym of whome he holdith / and for that this te­nāt may not aleyn in fee nor for terme of lyfe / And if he do it is well lawfull to hym i whome y e fee & y e ryght abydyth to enter.

¶ To hold in dower / is where a man in he ryte takyth a wyfe and dyeth / the heyre shall enter & indowe the wyfe of the thryd parte of all that that was to her husband in his lyfe in fee symple or fee tayle / and she shall hold these landis for terme of her lyfe as her free hold.

¶ To hold for terme of yeres is not but chatell in effect / for no accion is maytena­ble agayns the termour as to the recoueryng of the free hold / for no fre hold is in hym / a lesse for terme of yeres is chatell reall / and other chatell is all good is which is moueable.

¶ To hold i morgage is to hold to certeyn terme vppon condicion that yf the lessour pay somuch money at such a day that he [Page] may enter / & yf not y t y e other shal haue a fee symple or fee tayl or fre hold / & i euery case wher landꝭ or tenemētꝭ be gyffyn to a mā to a certayne terme vppon cōdycyon of y t part of y e lessour for to make y e lesse to haue more long tyme or terme yf y e other do not as y e cōdiciō ys / y e lōdys & ten̄tꝭ vntyll the day y t ye condiciō shuld be done / be holdyn in morgage / as in a dede gage.

¶ To hold in frank fee is to hold in fee symple landꝭ pledable at the cōmyn law.

¶ To hold in fee basse is to hold at the wyll of the lord.

¶ To hold in pure villennage is to do all that the lord wyll hym commaunde / The difinicion of villenage is villeyn of blod & of tenure / and it is he of whom the lord takyth redempcion to marye his dough­ter / or to make hym free / and it is he whom the lord may put out of his landys and tenementys at his will / and also of all his goodys and catell.

¶ And note well that a sokman is no pure villeyn nor a villeyn owyth not ward ma­riage nor relief nor to do no nother ser­uyce reall.

¶ And note well y t y e tenure in villenage shal make no fre mā villeyn if it be not cō ­tynued syth tyme out of mynd nor villeyn lād shall make no fre man villeyn / nor fre lād shal make no villeyn fre but yf that the [Page] tenaunt haue contynuyd fre sith the tyme of no mynd / But a villeyn shall make free land villeyn by seysyn or claym of the lord

¶ And note well if .ii. haue a villeyn in comyn and one of them make to hym a manumissiō he shall not be made fre agayns both.

¶ To hold in the tayle is where a man holdyth certayne landys or tenementys to hym and to his heyrys of his body begoten.

¶ To hold in the tayle after possibilite of issue extent is where landys is gyffyn to a man & to his wyfe and to the heyrꝭ of theyr .ii. bodyes ingendred and one of theym ouerlyffyth the other without issue betwen thē goyng owt / he shall hold y e land for t̄me of his own lyfe as tenēt in the tayle after possibilite of issue extynct. ¶ To hold by statute marchaūt is where a mā knolegith to pay certayne money to another at a certayn day before the mayre baylyff or other warden of any town that hath power to make execucion of the same statute and yf the oblige pay not the det at the day / and no thynge of his goodys lan­dys or tenementys may be found within the ward of the mayre or gardeyn be fore­seyd but in other placys without / than the reconyse shal se we y e reconysaūce & obliga­ciō with a certificaciō to y e chaūcery vn­der y e kyngꝭ seale / & he shall haue owl of y e chauncery a capias to y e sheryf of the coūte where he is to take hym and to put hym in prisō yf he be not a clark / tyl he haue made grement of the dett / And one quarter of the yere after that that he shalbe takyn / he shall haue his land delyueryd to hym selff to make gree to the parte of the det / and he may sell it whyle he is in prison & his sale shalbe good & lawfull / And yf he do not gree within a quarter of a yere or yf it be retornyd y t he be not found then the reco­nise may haue a wryt of y e chaūcery which is callyd extendifacias direct to al shyryfꝭ wher he hath landys to extend hys landꝭ & goodys to hym & to seyse hym in his landꝭ to hold them to hym and to his heyrys and his assignes til y t y e det be leuyd or payd and by this tyme he is tenaūt by statute mar­chaūt.

¶ And note well yf y e tenaunt by statute marchaūte hold ouer his terme he y t hath ryght may sew a gayns hym a venire far. ad cōputand. or ellys enter by and by.

¶ Ther be thre maner of rentys that is to sey rent seruyce rent charge and rent sek rent seruyce is where a man holdyth of a nother by fealte and for to do suyt to his court and yeldynge to hym a certayn rent by the yere for all maner of seruyces.

¶ And note well that yf the lord be seysed of the seruyce & rent beforesayd and they be behynd and he dystrayne and the tenāt rescow the distresse he may haue assise or a wryt of rescous / but it is more necessary for hym to haue assise than a wryt of res­couse / for so much that by assise he shall re­couer his rent and his damagis / but by a wryt of rescous he shall not recouer but the thyng and the damagis.

¶ And note well that yf y e lord be not sei­sid of the rent and seruyce and they be be­hynd and he dystrayn for them and the te­naunt take agayne the dystresse / he shall not haue assise but a wryt of rescous.

¶ And note well that yf the lord distrayn his tenaunt in socage for knyghtys ser­uyce which is not with sayd of hym and a vow for the same seruyce ī court of record he shalbe chargyd by the same seruyce / per

And yf y e tenāt dye the same tyme and his issue enter / the lord shall haue agayns the issue a wryt sur ces­saunt / or yf the tenant alayn / the lord shal haue agayns the alieue the foresayd wryt But yf the lord haue issue and dye and the tenant be in arerage of the sayd rent and seruyce in the tyme of the fadyr of the issue and not in y t tyme of the issue / he may not distrayne for the areragis in the tyme of his fader / & he shal haue no nother recouere agayns y e tenāt or any other for that y t sych aduaūtage is gyffyn by the law to y e tenāt.

¶ And note well that rent seruyce is / to the which be longith fealte / but to rent charge and rent sek longyth not fealte but yt be longyth to rent seruyce of comyn ryght.

¶ Rent charge is where a man grauntyth certayne rent goyng owt of his landys or tenementys to a nother in fee simple or in fee tayle or for terme of lyfe by dede vppō condycionn that at what day that the rent be behynd it shalbe well lawfull to the gra­unte or his heyres or assynys to distreyn in the same landys or tenementys.

¶ And note well that yf the rent be behynd it is well lawful to the graūte by eleccyon to haue a wryt of annuite / or ellys he may distreyn / & yf y e dystresse be takyn a gayns his will fro hym & he was neuer seysyd before he hath no recouere but by writ of res­cous / for y e distresse furst takyn gyffyth not to hym seisi but yf he hap y e rēt before for yf he were seisyd of y e rent before & after y e rēt be behynd & he distreyn & rescous to hī be mad he shal haue assise or a writ of rescous

[Page] ¶ And note wel that in euery assise of rent charge and ānuall rent or in a writ of ānu­ite it behouyth to hym that bryngyth the wryt to shew forth an especialte / or ellys he shall not maytayne assyse / but in a mor­daūcest our or formedoū in the descender or other wryttꝭ in the which tytle is gyffyn or cōprisid of rent charge or anuell rent it nedyth not to shew especialte.

¶ And note well that yf a man graunt a rent charge to a nother / and the graunte purchase the halff of the land wherof the rent is goynge owt / all the rent is extynct and yf the graūte relesse to the grauntour parcell of the rent / yet all the rent is not ex­tynct / But in rent seruyce not withston­dyng that the lorde hath purchaysyd the halff of the land wherof the rent is goyng owt / yet the rent is not extynct but for the halff / and the cause is of the dyuersite for that that rent seruyce may be seueryd to one parson but not rent charge.

¶ And note well that yf rent charge be grauntyd to two ioyntenauntys and the one relesse / yet the other shall haue the halff of the rent / and also yf one purchase the halff of the land wherof the rent is goyng owt the other shall haue the halff of the rent of his companion / And yf the disser­sour charge the land to a straunger and the disseyse bryng assise and recouer the charge is defetyd / But yf he y t hath ryght charge the land and a straunger fayne a false accion agayns hym and recouer by defaute / the charge abydyth.

[Page] ¶ And note well that in case that purparte be betwen two perceners and more land be alottyd to one than to the other and she that hath more of y e land chargyth her land to y e other and she happyth y e rent she shall maynteyn assise without especialte / and yf the graunte haue it in fee symple or in fee tayle and hath issue and dyeth / yf the issue bryng a formedone or assysc of mordaun­cestour he shall neuer be chargid to shew an especialte.

¶ Rent sek is wher a man holdith of me by homage fealte & other seruyce yeldyng to me a certayne rent by the yere and I graunt this rent to a nother reseruyng to me the seruyce.

¶ And not well that in rent sek if a man be seisid of the rent / and the rent be behynd he may not distreyn but he shal haue assise of nouell disseysyn.

¶ And note wel that yf rent sek be graun­tyd to a man and to his heyrys and the rēt be behynd & y e graūtour dye the heyre may not distrayne nor shall not recouer the a­reragis of the tyme of his fadyr as it is be fore sayde of rent seruyce.

¶ And in the same maner it is to sey of rēt charg or anuell rent / But in all these rentꝭ before sayd the heyr may haue for the areragis in his own tyme sych aduauntage as his fadyr had in his lyfe.

¶ And note well that in rent sek yf a man be not seisid of the rent and it be behynd he is without recouer for that that it was his own foly at the begynnyng when the rent was grauntyd to hym or reseruyd that he toke not seisin of y e rent as a peny or. ii. d.

[Page] ¶ And note well y t a man may not haue a cessa uit per biennum or a nother wryt of entre sur cessauit for no rent sek behynd by. ii. yerꝭ but they may all only for rēt ser­uyce as it apperyth in the statute.

¶ And note well y t in rent sek it behouyth for hym that sewith for the rent sek for to shew a dede to the tenaunt or ellꝭ y e tenāt shall not be chargyd of y e rent but wher the rent sek was rent seruyce before / as in this case / lord mesne & tenant & euery of them holdyth of other by homage fealte &. x. s. of rēt / y e lord ꝑamount purchaysith y e lādꝭ or tenementꝭ of y e tenant / all the signioury of the mesne but y e rent is extynet / And for this cause this rent is become rent sek / & y e rent seruyce chaūgyd / for he may not dis­treyn for this rent / & i this case he y e demaū dith the rēt shal neuer be chargyd to shew a dede / also in a wryt of mordauncestour ayle nor besayle of rent sek it nedyth not to shew a specyalte for y y these wryttꝭ of possessiō do cōprehend a tytle within them selff that is to say that the auncestour was seised of the same rent and continuyd his possessiō by cause of which seysyn the law supposith that it is also auerable by the countrey tamen quere for some suppose that yt be houyth of nessite to shew forth a dede for that that rent sek is a thyng agayns comyn ryght as well as rent char­ge / But in assise of nouell disseysyn and in a wryt of entre sur disseysyn brought of rent sek it behouyth of necessite to shew forth a dede for vat that rent sek is a thyng agayns comyn ryght except in y e case befor seyd where it was rent seruyce before
